American Law and The Syrian attack

The American attack upon Syria has been called illegal, uncontitutional and beyond the power of the Presidency. This is wrong and I will explain to you why.
The Congress passed the War Power Resolution after the Bay of Tonka incident. It is called an incident as even today there are question as to what exactly happened that night and if the US Navy was, in fact, attacked. The question and answer need not be addressed here. Congress did not like being dragged into a war without their approval. So then we jump to this attack, undertaken by the USA, UK and France. Was this an illegal action on the part of the President?

Even with the War Powers Resolution of 1973, it is generally agreed, that the commander-in-chief role gives the President power to repel attacks against the United States. The question is this strike such an act? When did Syria attack the United States? They did when Syria used poison gas to kill civilians, the Geneva Protocol, (1925) the 1972 Biological Weapons Convention (BWC) and the 1993 Chemical Weapons Convention (CWC). Whatever agent it is determined to be. As of this writing it is reported to be chlorine gas, a banded weapon used on the battlefields of World War One. Also, the 1998 Rome Statute of the International Criminal Court Makes it a war crime to employ chemical weapons in international conflicts. (2010 amendment extends prohibition to internal conflicts.) Thereby making this attack also a war crime subject to arrest by the international court.But even so, what does this mean for the USA in specific of the attack. What gives the President the power to attack Syria in the first place?
U.S. Constitution, Article VI: “This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land…” (Note that the USA is treaty member listed above.)

That rule of law kicks in here, no judge can deny the obligation of any formal treaty entered into by the US government.

Kind of obvious, but needing to be said, you took an oath for your position in government, you are bound by this oath to support the Constitution and thereby by adoption, all treaties as well.
As such, a violation of said treaty, against use of chemical weapons, that has been officially approved by the Senate, and has becomes part of American law, must be protected. The Executive, aka The Office of President, must therefore protect the law of the several state and the rule of law by protecting the treaty as it was any other part of the Unitied States. You cannot decide to not protect Montana or ignore those parts of the criminal code you do not personally agree with. By your oath or affirmation, you are duty bound to uphold the treaty.
Thus by international law, International Treaty law, American law, and the American Constitution, the USA must protect the treaties it has signed as if they were a part of the United States. This includes the one against attacking civilians with chlorine gas or nerve agents. Thus Syria attacked the USA by defying the treaty against said use of controlled weapons, just as if the attack was on downtown New York.

In so much as you can cherry pick your facts based on whatever criteria you need to do, it is clear that the debate is simply one of a small minority of gun owners who will try with any argument they can muster to find legitimacy for their position in the face of overwhelming calls from the population to control weapons. When 97% of Americans call for stricter background checks before allowing for a purchase, this is not a small minority. It is everyone who thinks this is fair and needed.

Dark Sisters

The place holder that is dark matter and dark energy; the lingering mystery of the unknown; will it ever be solved? Ok fine, the universe is missing matter and energy. Scientists call this dark matter. But it is meaningless. It is merely a place holder for “Whatever that is.” they say they cannot detect it because it is dark. And there is none around here. Same with Dark Energy. So let me see if I can understand you? The universe is filled by like 95% of energy and matter to be this “Dark” stuff. Yet for some miracle there is none around us locally. Einstein is wrong. God does play dice and tosses them were we cannot see them, according to Hawking. Except the reason why we cannot see them is not cause they are hidden or too hard to see. We cannot see them because we refuse to look. Dark Matter and Dark Energy to be so prevalent in the universe must mean they are everywhere. As such, a uniform or near uniform distribution of the Darks must be to everywhere in the galaxy. That would, by necessity, mean they would fill up the local space as well. Stop looking for Zebras and start looking right here on planet Earth in the Sol system for the Dark horses. We may not see either in deep darkest space but we should not need to. The Dark sisters should be right here, right now and thus we should be able to find it and study it without leaving our own front yard. All we have to do is start to look in the right place.

Last days of Pompeii

It’s the last days of Pompeii. The ground is trembling! The mountain is smoking and rumbling but no one is paying any attention to it. It won’t mean anything. It’s just smoke and noise… until it explodes. The year is not 1952. The population is not overwhelmingly White males. White females do not quietly sit at home for their “Man” to return and tell them what to do, who to vote for and what to think. Minorities are no longer practicing some pre MLK “Civil Elegance” where they know their “Place”. The world is changing. American white will become a minority in the next 20 years. The present millennium generation is more likely to vote liberal and progressive then they are to be republicans or religious conservatives. People are on the march and on the move. And while it may not seem like much the storm clouds are building for a very rocky future. The white males who overwhelmingly hold the reins of power in the GOP are finding their path to power getting narrower. Pennsylvanian and soon Supreme Court of the United States are going to rule on Gerrymandering. And then the votes will be counted properly across the voting public. Suddenly, you won’t have any safe seats for anyone but have to win the election each and every time. Mass movements will not be restricted to the right wing but any wing. With the millenniums coming to vote, minorities and increasing liberal views on social policies ingrained in the population, the era of the white republican man, is about to go extinct due to “Climate Change.” 2018 may be the most pivotal year in voting history as more and more people are getting pissed off and voting. An engaged democracy? Something near unheard off thus far in the USA? The complacent Republicans may see their bastions of power removed or shrunk to mere nothing.
What does it look like when the GOP lead by Trump has to court those Rapists from Mexico? Those Muslim Terrorists and all those undesirables that he openly hates from his podium? I don’t think that will go over well with the average Fox News watcher? Yes things look bad now. It’s the last high water mark for them. Starting soon the tide reseeds, the flood withdraws and sanity will be restored. Too bad for the memories of those who remain? The next populist who runs for office with such a racist ideology will swiftly be cast aside. Even the Trump base is held together by one man and that is trump. David Duke could not hold the Trump coalition together with tape if he tried. In the end, GOP politicians will have to court those they hate. Just like it was a mistake to have Michael Steele as their chairman, so they say, because… gasp he was black. Like they could not see that before they elected him? But he attacked Trump! How dare he? Of the female conservative columnist at CPAC? Mona Charen had to be escorted out by security because she dared to offer an opinion that Donald J Trump is not above the room, and not above answering for his raping women or attempting to do so. Women and minorities who happen to be conservative are seeing the writing on the wall. They are not welcome. Kids are seeing the target on their back painted by gun policies. All of them have one thing in common. They can vote. They will vote and they will shake the world with their righteous anger at the people sitting in Washington who ignore them, patronize them and belittle their views as unsophisticated and uninformed. Woe be it upon the incumbent. This election will see many tossed to the wolves as the people, the real power in a democracy will lash out in ballot to take back the country from those who think they are entitled to their office by virtue of support their donators.

The night is dark and the dawn so far away but each morning, there be a sun to rise and chase the shadows away. The dawn will come as surely as there is a night to sleep in. The alarm clock will ring and the day will begin anew. Worry not for we the people are slow to anger but overwhelming in our march when we take back the spotlight of those who will not listen, who will not serve and who will not remember that “We the People: are their bosses. Not the corporations and not special interests. The Sun will dawn and the tide will recede, so too will the Trumpists be voted out of office.

One Bill

One bill is needed to restore gun safety to America; it must include the following and more:

Ban all enhancements like bump stocks that make legal guns automatic. DOJ can regulate and ban any physical modifications under their own authority.

Ban all assault rifles. Three years to surrender them or be subject to criminal arrest.

Mandatory waiting period before you can take possession the gun of 10 days if you have all the legal paperwork completed. Longer wait time if the paper work is not completed until it is.

No more gun show sales. Mail order or any other order are prohibited  except for sale done in person at a gun store where they have verified all legal requirements of the sale before handing over the weapon after the waiting period.

Mandatory background checks that must be fully completed before you can buy the guy. No sunset clause on any potential delays. If it takes a month then it takes a month and you have to wait for it to be completed.

All criminals convictions, including both state and/or federal crimes, potential terrorists on watch lists, mental health issues and domestic assault cases, even if they are not yet convicted in court are banned from owning, purchasing or holding any weapons until they are no longer suspected, on the watch list or granted a full pardon. A criminal is not allowed to vote why can they still own a gun?

A direct tax is to be levied on the sale of ammunition and on all guns. Call it the safe school tax. You want to buy it then time to pay up for the un-safety of our schools.

Repeal federal legislation that prohibits direct suit against gun makers for the carnage caused by their guns. As well as allowing lawsuits against anyone who may have advocated the use of guns. Hello NRA.

Mandatory safety class consisting of 72 hours of classroom and field training to be completed before one is granted a permit. Let’s make sure that people actually know what a gun is, how it works, how deadly it can be and be sure they can understand the implications when they decide to pick up a weapon. Refresher course every 2 years of 48 hours in length is required in order to retain your permit.

All open carry of weapons must surrender proof such as their federal permission to own this gun when asked for by law enforcement. No suspicion needed other than to request proof you own and can legally carry such a weapon.

Federal carry permits for all weapons to be paid for with the tax money from the sale of guns and ammo as well as registration fees.

Yes, that would still not eliminate the deaths but it would start to curtail them. Only problem is will such a bill survive the US Supreme Court Challenge? Looking over this list I think it would survive such a challenge as there are requirements similar to each one of these that have survived such cases already. And where would I find a Congress and President with the courage to make this into law? Certainly now with this congress and absolutely not with the spineless President we have now. He is too busy golfing.

Donald Trump has had two affairs with models in the news this month and last including one with Porn Star Stormy Daniels. Fake news.

Both are lying.

Donald Trump is accused of groping, grabbing or otherwise sexually harassing some 17 women. Fake news.

All of the women are lying or paid to lie.

Donald Trump is caught on an Access Hollywood trap expressing to 10 males that he would sexually assault women by grabbing them by the P-$$y, including Billy Bishop. First, he apologised and now it is all fake news including his apology. All Fake news. Made up fake news.

Russia scandal is also all fake news.

Including in this category would be the indictment of near 20 people and the guilty pleas of 5 Americans. Surely this is also fake news.

NRA spokesperson Dana Loesch: “Many in legacy media love mass shootings. You guys love it. Now I’m not saying that you love the tragedy. But I am saying that you love the ratings. Crying white mothers are ratings gold to you and many in the legacy media in the back (of the room). And notice I said ‘crying white mothers’ because there are thousands of grieving black mothers in Chicago every weekend, and you don’t see town halls for them, do you? Where’s the CNN town hall for Chicago?” said at Conservative Political Action Conference on Thursday February 22, 2018.

Because the calling of this massacre as fake news was too much? So instead, this shooting is being blamed on the media, aka the ones who report on fake news. Never mind the sheer irony of her statement. Thousands of black women n Chicago? She is literally saying that there are thousands of gun deaths in the City of Chicago every weekend. Why is there no town hall? There has been. Many of them. So many that it is not even a blip on the national news. Too many are killed by gun violence to report them all. No amount of newspapers will soak the blood, let alone the tears. And yet nothing has been done to stop the violence.

And why not?

The myth is any action is against the second amendment. This is not true. Despite the claims of so many gun nuts about what the second amendment means, the only ones with the last word is the United States Supreme Court (SCOTUS). And they have ruled. The government can ban any class of gun, except a hand gun. They can ban large magazines. They can prohibit the buying of weapons without background checks. Place age limits on the purchasers. Make the sale delayed for any reasonable wait time. They can demand that people show identification if stopped by police when open carrying a weapon. They can tax ammo and weapons. They can demand safety courses and so much more. And yet all of this is fake news to the supporters of gun ownership. Yet it is all adjudicated law. SCOTUS having ruled on similar laws over the years have said all of this is allowable. Yet nothing is done. Because it is all fake news.

But in the most ironic of all statements? Loesch touched on black mothers. When in the 1960tys in California the Black Panthers began to arm themselves for confrontations with police what happened? The NRA came down on the side of law enforcement to produce some of the hashes laws in American restricting gun ownership. More fake news only in this case fake historical news.

At what point do you drop the whole notion of fake news? The irony is that the Russian scandal is called fake news about the Russians, in part, trying to press onto Americans during the election fake news itself. The Republican Party is now the party of calling what it does not like “Fake News.” They can fool some of the people some of the time, they won’t fool all of the people come November!

Gun Crimes

First they blame guns. Not a gun’s fault, it is the shooter. So they blame the shooter, but it is not their fault, they are mentally ill. So they blame the parents for not seeing the problem. But then they often don’t have parents or are living on their own so they blame social media. Which means; we are all guilty of not seeing it happen before it happens. So in the end when all are guilty, no one is punished and no one is to blame. And the wheel spins around some more, where everyone in the circular firing squad blames someone else. Nice, but it solves nothing. Gun crimes are not based on legislation, little or lots, it is based on enforcement. And that depends on popular whims of society and those are fleeting. People will forget each massacre in turn as other things grab the news and people’s attention and so gun crimes will be left aside, until the next massacre. The one common denominator is for all gun crimes is not mental illness, gun laws or parental influence. The one thing all gun crimes have in common? Guns. Limit the number and remove them from the hands of people and you have a more perfect union. The lack of guns in Japan does not mean there is no crime, or there is no violence. It means there is no gun crime. Switzerland has loads of guns in every household. Or does it?  In Switzerland all males are in the army. They have a fully automatic weapon in their house, ever house with an adult male and that is most of them. Yet low gun crime. Why? Because those who are issued a gun are also tested for mental fitness and reliability. They are indoctrinated by 2 years in the military service where they are drilled and drilled again on gun safety. Every single day they are force to show respect to their weapon and punished harshly for any infractions, as they should be. After two years of this training, they are no more likely to go against that sort of training and discipline then they are to learn to fly by simply not hitting the ground, (as Douglas Adam’s might phrase it). In the USA, if you are lucky, they have had a fire arms safety course and that is a big if. Without proper screening, background checks and waiting period laws to reduce spur of the moment events, there can be no safety. Without positive action to reduce and collect guns from the population and reduce the overwhelming amount of firearms held in private hands, the next school shooting is mere hours away. Somewhere right now, some kid is talking to himself while stroking an assault weapon how he is going to “Make them pay!” He is going to “Show them all.” And the worst thing is this. It is not even a guess or mere speculation that this is going to happen. It is. Period. And there is not, nothing, we can do about it. We can do a lot right now. There are many things we could do about it. But we won’t do a darn thing. So how many more will the next lone wolf kill? How many more young lives will be killed because no one has the courage to do anything about it? Making it easier for mentally ill people and people on the terrorist watch list to own guns is not the exception of politic action. It is the norm. This is no longer the options but the features of American gun Violence It is the normal for Washington. Keep that in mind as we bury another 17 dead, forgotten tomorrow for the next mass shooter’s kill count will be higher or more shocking or will it be just fresher?

Basic Math

Some basic math for the unenlightened.

America has 330 million guns which is roughly the population of America. Rather put then, there is one gun for every man, woman and child alive in the USA. 75 % of the population does not own any weapons. That means 25% of Americans do. 3% own half of the total guns, or 165 million weapons. That is roughly the amount of Americans who hold Phds (3.27%). That leaves the other 22% to own 165 million weapons. 22% is the percent of people who have blue eyes world wide, not just in the USA where the numbers are slightly higher at 33% of whites having Blue Eyes. Gun nuts, that 3% or about 10 million people. own on average 16.5 weapons each. The other citizens armed have on average 2 guns per person. One might assume, one is a long gun, like a rifle and the other a handgun.

1 in 5 or 20 % of the population will have some form of mental health issue. 1% will have a bipolar disorder. Therefore of the 10 million people who own 16 or more weapons on average in the USA, 100 000 of them will be bipolar. How many of them will resist the urge to kill? How many will ever see anything wrong with have so many guns and hearing voices telling them or ordering them to kill?
How many indeed?

Three of the top ten mass killings by gun violence have occurred in the last year. The number of school shooting so far is 18 and we are not even finished February 2018 yet. In 45 days we have had one school shooting every 2.5 days. Twice a week and the trend line is increasing. Yet despite all of this, the only gun control law to pass congress was to remove restrictions on people with mental illness from owning guns. Who says Congress does not care?

If you look at the boxes for Amazon.com you will see an arrow going from a to z in the name.  They say this is because they have everything you need from A to Z. Oh really? I think they might be claiming to be divine in status. Or that might just be a conspiracy theory I am creating?

Miscegenation and Transphobic

On the British version of Big Brother a question was asked:

“Would you date a trans woman?”

The question is simple but it hides a much deeper conversation. The correct answer would be of course not. (Please feel free to trigger yourself now.) People will assume this is transphobic without even understanding the very question itself. The problem is that this is all such a new subject that is finally entering into mainstream that we have forgotten the lessons of the past.

In the 60tys, in the American South, (Similar laws were also in effect in South Africa extending until the end of Apartheid.)It was illegal to marry someone who was of a different race or color. The correct term was “Miscegenation,” that forbids the marriage of whites with blacks. In cruder terms, it has been called jungle fever, Asian Rage, Hispanic Panic and so on. So let’s rephrase the question, would you date a black woman? Well since most people are not racist, they would answer yes.  And they would be missing the point of the question and their answer would be racist.  The distinction here is best summed up by the following question. Can a Jesuit pray while smoking? Or is it he may smoke while praying? But those are the same question, are they not? In fact, the answer is they are not. A Jesuit may do what he wants so long as the emphasis is on the praying not on the smoking. Nothing should be in the way between a priest and his God, so the pray must be the thing of important, the smoking is therefore incidental. Back to the dating a “Black” women. Is the emphasis in the question based on the person? Or is it on the race of the person. They are speaking of a “Black” not dating the women, but the skin colour, just as the original question is based on the “Trans” not the woman part. Thus the question itself is wrong. The only person who would answer “Yes” is called a “Tranny Chaser,” someone who is into the sexual fetish of dating Trans people and had no intention of dating a real person. Similar to the person dating some women who is “Black,” they are ignoring the person in favour of the emphasis on the colour. And this is racist.

The better question would be; “Would you date a women who happens to be…” (Insert ethnic, cultural, or any other feature you might wish to separate from the larger collective called women.)

The question thus becomes, would you date a women who happens to be transgender. Providing there is mutual attraction and appropriate ages are observed, (That means you Roy Moore!) then the answer is yes because the person under discussion is addressed  not as an issue and not as a statement but as a person. And “persons” are who we date, not abstractions and classifications. Date by personality not by fetish.
